Benefits of Mediation
Mediation differs from adversarial resolution processes by virtue of its simplicity, informality, flexibility and affordability. Typically, the mediator will meet face-to-face with both parties involved. Individual attorneys need be present only if requested by the parties. Parties have an equal say in the process and decide their own settlement terms. You are in control. The mediator remains neutral and objective throughout the process and is there to facilitate and guide the process, not to make decisions or judgments.
Most mediations are completed in from one to three short meetings, thereby saving you time and money. It is confidential, fosters cooperation and improves communication. The mediator will use skills such as intentional listening, interruption of old patterns of interaction, establishing a new bridge for communication, identifying issues and possible options and de-escalating the hostility that may be present.
Mediation avoids polarization of the parties, and allows for the exploration of issues which the court system simply cannot address. As a result, it may provide greater access to true fairness and justice.
